Giudici e politica: un confronto all'americana

Uno dei tratti fondamentali del sistema giudiziario Americano è la possibilità per la popolazione di eleggere i loro giudici. Il Giudice Lynch mi ha parlato di questo argomento quando mi espose la sua elezione nonché il fatto che nessuno è corso contro di lui quando ha cercato di essere rieletto. Ciò forse era dovuto al suo buon lavoro, alla sua popolarità o ai rischi legati a tale carica, tra cui la possibilità che bande criminali si vendichino per le sentenze pronunciate dal giudice. Volendo confrontare questo sistema con quello europeo, dove generalmente i giudici vengono scelti con pubblico concorso volto ad accertarne le competenze giuridiche. In Italia in particolare, una volta superato l'esame il giudice rimane in carica a tempo indeterminato. L'obiettivo del sistema italiano è quello di garantire l'indipendenza dei giudici dalla politica e dimostrare che non essi non sono influenzabili nell'applicazione della legge. Ciò è coerente con la tradizionale principio della separazione dei poteri, apparso come un significativo limite durante il regime fascista. Dunque i giudici Italiani sono sottoposti alla sola legge e soltanto davanti ad essa saranno ritenuti responsabili; ciò accresce l'autorevolezza dell'amministrazione della giustizia, immune da qualsivoglia influenza politica. Il Consiglio Superiore della Magistratura, una commissione composta per due terzi da giudici eletti dai loro colleghi e per un terzo da giuristi di fama nominati dal Parlamento, assegna ai giudici la loro circoscrizione e gestisce nello specifico il loro rapporto di lavoro. In America invece i giudici sono molto più legati al potere esecutivo. I giudici Americani, infatti, sono eletti dai cittadini oppure nominati direttamente dal Governatore. Ciò probabilmente è dovuto al successo della teoria della separazione dei poteri in seguito alla rivoluzione francese del 1789. La Costituzione degli Stati Uniti, leggermente precedente a tale data, pone le basi del sistema Americano con un accento su tale dottrina molto minore che in Europa. Così il sistema giudiziario Americano è maggiormente suscettibile alle influenze ed agli interessi esterni. Per esempio, grandi imprese possono finanziare la campagna elettorale di un giudice ed egli potrebbe ricambiare il favore concedendo, ancorché illegalmente, un trattamento preferenziale qualora ve ne fosse bisogno. Inoltre, un governatore o un presidente potrebbero scegliere i giudici in modo da garantirsi un'interpretazione favorevole della legge, indebolendo così il controllo giudiziario sui due rami politici del governo. Un esempio storico mostra la conseguenza di un giudice troppo strettamente legato alla politica. L'influenza che il presidente Franklin Delano Roosevelt ha avuto sulla Corte Suprema durante l'interpretazione della clausola sul commercio interstatale della Costituzione ne è un esempio evidente. Infatti, inizialmente la Corte Suprema ostacolò la politica del New Deal di Roosevelt e dichiarò illegittime molte delle sue norme. Siccome però il Presidente degli Stati Uniti nomina i giudici della Corte Suprema e non vi è un limite al loro numero fisato nella Costituzione, il Presidente può nominarne quanti ne vuole, anche se generalmente essi non sono più di nove. Quando la Corte Suprema bloccò la politica del New Deal, allora il presidente Roosevelt minacciò di nominare altri giudici per avere una maggioranza nella Corte Suprema che sostenesse il suo New Deal. Posta sotto tale pressione, la Corte Suprema tornò a più miti consigli e sostenne il nuovo corso del Presidente. Oggi quasi tutti considerano il New Deal come un evento positivo nella storia Americana e di tutto il mondo. Tuttavia, questo esempio mostra il peso che il potere esecutivo ha nel sistema giudiziario Americano. In sintesi, il sistema europeo sembra concedere più i diritti alle parti, ad avere un giusto processo e procedimento di legge. Infatti, è molto più difficile sostenere che alcune sentenze abbiano una fonte politica. Comunque anche il sistema europeo non è esente da alcune lacune. La mancanza di controllo sull'operato dei giudici rende il loro lavoro generalmente poco efficiente. Inoltre, è difficile valutare il loro comportamento per mancanza di un serio sistema che prenda in considerazione le loro competenze ed il valore del loro lavoro. Ogni valutazione del loro lavoro potrebbe essere interpretata come un'influenza illegittima e discriminatoria nei confronti di un giudice coraggioso o delle sue opinioni innovative. Quello che sembra mancare un'efficace forma di controllo. In ogni caso, qualcosa potrebbe cambiare in seguito ad una recente riforma che ha introdotto una più efficace azione di responsabilità contro i giudici che hanno agito dolosamente o con colpa grave. L'azione, di carattere civile, prevede che il giudizio sull'operato del giudice sia demandato ad altri giudici suoi colleghi, evitando così influenze ed ingerenze di altri poteri dello Stato.

A COMPARISON WITH THE EUROPEAN SYSTEM

One of the famous characters of the American judicial system is the chance for population to elect judges. Judge Lynch introduced me into this argument when he told me about his election as a judge and the fact that none run against him when he tried to be re-elected. Perhaps that was due to the good job done, or to his popular, or to the risk related to such a position, as criminal gangs would vindicate themselves for judge's opinions.

This system is usually compared with the European one, where the judges are enrolled within the civil service after a competitive exam to ascertain their legal competences. In particular, in Italy an exam selects the judges and once passed that, a judge has his position granted for his entire life. The main concern in the Italian system is to grant the independence of the judges from political process and show that there is not undue influence in the administration of the law. The division is consistent with the traditional provision about separation of powers, which, after the fascism regime between the two world wars, had seemed the major limitation to the settlement of another dictatorship. The second one is to increase the prestige of administration of justice, as the judges is liable only in the face of the law and so their opinions are undoubtedly expression of that law, instead of a political party. After a competitive exam, the CSM, a commission composed for two third of judges elected by their colleagues and for one third of famous jurists appointed by the parliament, assigns the judges to their specific district and manage their labor relationship.

By contrast, in America the judges are much more linked to the executive branch. In fact, depending on the state the American judges are elected by the citizens or appointed directly by the Governor. This was probably due to the fact that the greatest success of the separation of powers doctrine was only after the French revolution in 1789. As the US Constitution was slightly precedent that date, the bases of the American system were yet settled and the stress on separation of powers has been minor than in Europe. This could lead to some kind of influence of external sources or interests on judicial system. For instance, huge corporations would fund the electoral campaign of the judge or criminal gangs could support him to grant themselves some favor in the future. Moreover, a governor or a president would choose the judges that interpret the law in the way he considers appropriate, weakening this way the judicial check on the 2 political branches of government.

An historical example could show the consequence of a judge too strictly linked to politics. In fact, the influence that President Franklin Delano Roosevelt has had over the Supreme Court during the interpretation of commerce clause is an evident sign of it. The question rose when the Supreme Court initially refused to accept the provisions of the New Deal. As the Constitution does not establish a number of Justices for Supreme Court, the President is free to nominate as many Justices as he want, even though generally they are 9. When President Roosevelt threatened to nominate other Justices to have a majority in Supreme Court that support his New Deal plan, the majority opinion in the Court switched in favor of New Deal provisions. Now almost everybody consider New Deal as a positive moment in the history of America and of the world. However, this can show the strength of executive influence over the judicial system in America.

In sum, the European system seems to grant more the rights of parties to have a due process of law. In fact, it is much more difficult to argue that decisions of the judges have a political source. However, the European system has some drawbacks. The lack of control on the judge gives a minor level of efficiency. Moreover, once the judge is enrolled in his position, it is hard to evaluate the value of his work. In fact, every evaluation could be interpreted as an undue influence or a discrimination against a judge for a brave opinion. The check on judicial branch seems lacking. However, something seems changing in recent years. In Italy, for instance, a new law has introduced a more effective action to take liable a judge who acted with malice or gross negligence. The action is a civil one, so the judges would administer this check on their colleagues, avoiding this way influences from other branches of government.
